This Privacy Policy explains how Kazan LTD ("we", "our", or "us") collects, uses, shares, and protects your information when you use the Birder mobile application and related services (the "App"). We are the data controller of your personal data. Birder is intended for users aged 13 and over.

We use your information to: identify the birds in the photos you upload; maintain your bird collection and unlocked cards; operate, maintain, and improve the App; ensure security and prevent abuse; debug and diagnose issues; provide customer support; and measure and optimize our advertising. We process this data to perform our contract with you, on the basis of our legitimate interests in operating and improving the App, and to comply with our legal obligations. Where we share advertising and measurement data with Meta, we rely on your consent (given through the App Tracking Transparency prompt on iOS). We never sell your data for money.

We share data with service providers who process it on our behalf, including:

We do not sell your personal data or your photos for money. We do share the limited advertising events described above with Meta to support our marketing; under some laws (such as the California CPRA) this may be considered "sharing" for cross-context behavioral advertising. You can prevent this at any time: on iOS, decline the App Tracking Transparency prompt or turn off tracking under Settings > Privacy & Security > Tracking. We may also disclose information where required by law or to protect our legal rights.

4. International Data Transfers

Our services are hosted in, and your data may be processed in, the United States and other countries that may have data-protection laws different from those in your country. Where we transfer personal data outside the UK or EEA, we rely on appropriate safeguards such as the relevant Standard Contractual Clauses. By using the App, you understand that your data may be transferred to and processed in these locations.

5. Data Retention

Because Birder uses anonymous accounts, your photos and collection data are linked to an anonymous identifier stored on your device rather than to your name or email. We retain this data for as long as your anonymous profile remains active, so that your collection is available to you.

You can permanently delete all of your photos and collection data at any time directly from within the App. Once deleted, the photos are permanently removed from our servers and cannot be recovered.

In addition, we automatically delete photos and associated data linked to anonymous profiles that have been inactive for 24 months. We retain anonymized or aggregated data that can no longer be linked to you, and we may retain limited records where required to comply with legal, tax, or accounting obligations.

6. Data Security

We use industry-standard technical and organizational measures, including those provided by Google Firebase, to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Children's Privacy

Birder is intended for users aged 13 and over. We do not knowingly collect personal data from children under 13. If you believe a child under 13 has provided us with personal data, please contact us and we will delete it. If you are between 13 and the age of majority in your jurisdiction, please review this policy together with a parent or legal guardian.

Depending on your location, you may have the right to access, correct, delete, restrict, or object to our processing of your personal data, and the right to data portability. You may also withdraw consent where processing is based on consent. To exercise these rights, contact support@kazansoftware.com. If you are in the UK or EEA, you also have the right to lodge a complaint with your local data-protection authority (in the UK, the Information Commissioner's Office).
